Abstract |
Background. The article analyzes the anti-corruption expertise of regulatory legal acts and their projects carried out by the prosecutor's office. The author notes that, despite the positive results of the prosecutor’s practice of conducting anti-corruption expertise, the current legislation still contains regulatory prescriptions that contribute to the appearance of corruption acts, and there are also a number of problems in the organization and conduct of anti-corruption expertise of regulatory legal acts and their projects. The purpose of the study is to develop a definition and clarify the object of anti-corruption expertise. Materials and methods. The research goals were achieved thanks to the scientific analysis of sources devoted to anti-corruption expertise. The dialectical method, the systematic approach and the formal legal method were chosen as the research methods. Results. The article analyzes the object of anti-corruption expertise, which needs to be expanded to include regulatory agreements (agreements) and their drafts, law enforcement acts. Conclusions. The value of the Institute of anti-corruption expertise is great. It is thanks to this preventive measure of influence that abuse of law and arbitrariness on the part of officials can be eliminated. Meanwhile, it is necessary to improve the current legislation regulating the rules and methodology of anti-corruption expertise. |
